My I-485 is pending and priority date is OCT 2006. We have EAD which expires in DEC 2010. I also have H1B visa which expires on JUN 2010 (After 3 years of extension after I-140 approval.) My question is:

1. Is it worth having H1B visa extended just in-case? Will extending H1B visa cause any problems with pending I-485?

I appriciate yr help.

Sounds like a fraud!
I am new to this forum. Just registered myself. I hv a question if u guys can help. I got an RFE for I485 for employment verification. Lawyer says he sent the employer verification letter with his signature instead of employers bec employer has given him authorization to do so. can anyone do like this. does this pose a problem for my I485 approval. Please help.

Hi Guys
I went to local USCIS office today and asked about my case status. My I-485 was filled on 08Feb07 in EB2 category. A lot of people who have fillled I-485 after me, have already received green cards.
The Immigration lady was very nice and she told me that my case can not be approved as my name check is still pending with FBI. The name check was initiated on 24Feb07. She created a service ticket for me providing a target date of middle of next month. The ticket said that "Please approve asap after getting clearance from FBI". I do not know what does that mean? Still trying to figure out???

Then I asked about name check status of my dependants. She mentioned that their name check has been resolved which is different from cleared. She created a different SR for my dependants requesting Approval of Green cards as name check has been resolved again giving me mid of next month as target date. Does it mean that my depandants can get approval before my approval?
Gurus Any idea what should I expect. Do I need to continue to follow up with FBI and senators regarding my name check and collecting information for case file?

When I sign in to USCIS online status for my 140, I found this

Following is the situation:

My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).

Falling short of 10 weeks to get the 365 days rule

Options that I learnt for me getting 7th yr extension and staying in the country:

Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.

Option 2:

Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)

Option 3:

Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)


Option 4:

Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

Can the gurus/experts please put in any issues I might be running into or if any of the option above are not at all feasible(may be I am ignorant)

I had F1 visa from July 2002 - July 2007 stamped in my passport. I moved to H1b in Oct 2004 and stamped my H1 Visa in June 2005. So you can move to H1B from F1 without stamping any visa only if you have to leave US then you need to get the new H1 stamp before re-entering. Also do not forget to fax a caopy of your H1 approval notice to your school's international center so that they can stop reporting you in SEVIS

Hi,
I have AOS and was recently laid off from my job. As I haven't found another job by the removal-from-payroll deadline, my H1B will expire. My question is, once I get my EAD, can I apply for a new H1B. The motivation is that I can bring a spouse over on a dependant visa only on H1B but not on AOS. How should I work this out?

Photoshop might have a filter that could do this, although I'm not sure off the top of my head. I'd go with the Flash version myself, it's quick, easy and you can cut and paste the result into another package without any hassle.

USCIS record shows my entry year 2003 but actual year is 2005, so they came back saying 6 years is complete. Lawyer provided all the documents to prove I am here only from 2005...

To answer your second question, yes, the employer can revoke your I-140 petition which could result in denial of I-485 application. You are only covered under AC21 if your I-485 has been pending for more than 180 days as the previous poster suggested.

My employer will be filing for my greencard (labour certification) within the next 2-3 months. I have a valid H1 B visa expiring next year. I was wondering if it is legal to travel outside the country at this stage ?

Any advice would be appreciated.

if so, will the priority date be same or it will be new once converted to F1 category.

IT WILL STAY THE SAME.

2. Can I apply for both family based and employment based in parallel?

YES, THIS IS COMMON.

if it is not possible which path should I select? Will the employment based GC will be faster of family based?

FAMILY-BASED AS THE UNMARRIED CHILD OF A US CITIZEN IS PROBABLY FASTER, ASSUMING YOU ARE FROM INDIA.
