Hi,

Do anybody know what are the documents that i have to provide to my new employer for the H1B transfer process. I heard that i need to provide all my PAYSTUBS along with my orginal H1B papers.

Is that true ?

e-file your i-140, then you have 7 business days to send in your supporting documents (receipt notice is generated immediately from your printer). I-485 can be filed before August 17
I have read somewhere that e-filed 140s are processed by TSC [which is a good thing for me because I have heard that TSC is lenient with cases like mine - 3 year degree ]

I believe you can change your appointment 2 times ( or probably three times only ). You should be able to change your appointment to Delhi if dates becomes available and you are within the limit of number of changes of appointments allowed.

Hi All,

I would like to know if i can file multiple 485s being primary on both ?

Here is my current status ...

1. Company A sponsored my GC and the priority is Oct'03 (never worked for this company)
2. Company B sponsored GC (priority Nov'05). - Currently working for this company
3. Both are EB-3
4. Applied 140 & 485 thru concurrent processing (Company A) in 2004
5. Now that all the dates are current, I am eligible to file 485 (Company B)

So my question is can i have two 485s filed ?

First case is future employment case but has '03 priority
Second case is more strong, but with '05 priority.

I am confused, what to do now.

Any advice is appreciated.

while applying I140 wife name is not mentioned on the 140 petition.

you can file for a change of status to H-1, but you cannot begin working until the change of status is approved. Alternatively, you can travel to a US Consul, obtain an H-1 visa, re-enter the US using the H-1 visa and then begin work.

Does this work as shot or does it need fill flash. Since it was about 18 degrees with a stiff breeze out of the north and my fingers and toes were frozen, I'm not sure I would have bothered with a flash, regardless, but would appreciate knowing what people think for when I shoot the same kind of shot in warmer weather. (Yes, I know I blew out the feathers on the back.)

I have 2 H1B Transfer questions for clarification.
1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?

Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.


2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.


The 140 approval notice is not required unless this is a post six year transfer/extension.

I will be travelling outside US using AP by end of this month. I don not have valid stamped visa. Recently small part of my old company (A)got acquired by new company and my job was moved to new company (B)

Lawyer at company B applied for New H1 in May 2008 ( old is still valid till 2009)�but haven�t received approved 797 notice yet.

Can I travel outside US and comeback without haveing approved new 797 notice. I do have EAD and old 797.

Any issues ? I don�t want to abandon my H1 status.

Gurus please advise.

pnagar: (1) Employment Verification Letter with your Job roles, responsibilties, which should match/similar to your GC labor; and your annual income. (2) Once your 140 is approved and 180 days have passed after filing 485; it will not affect you even if your employer withdraws the 140 application. It will affect only if USCIS revokes based on fraud grounds.

For the PD of 07, it is a long way to GC with out the help of organization like IV - If you have time, take look at the omnibus fund raising and help in anyway you can.

He can have both types of permanent residence pending at the same time - marriage-based and employment-based. This is very common. The marriage-based filing will probably be approved sooner than the other, because priority dates are so backlogged now.

I am completing my h1 4 years and 7 months..

Planning to apply for GC.....I don't know about PERM processing...

1, How long its taking for PERM processing (including ad etc.,)?

2. Which center is doing PERM faster?

3. will there be any issue if 2 companies file for LC for me in the same center? my current employer is going file LC, but thinking to join some other company.

Hello Attorneys/ known guys, ( first of all sorry for reposting new thread , i ddidnt get anyanswers but ead and ap expire time is coming soon )

How are you doing ? i am new to here. i will fill all details soon. sorry for that.

Before i stayed in place "X " which comes under nebrasaka centre, applied for 485, ead and ap. my company also in " X " only.

Right now i am in place " Y " which comes under Texas centre ( because of my job i moved recently) . Now i want to renew my ead and ap my self . my job, payroll and living is in place " Y " only.

But my pemanent address is " X " only. I want to continue that for my full GC process.

what my question is what i have to mention the address for my ead and ap renewal ?

1) is it "X " address as it is my permanent address and applied my 485 also from there and wish to continue or my "Y " address as i am working , living and payroll are here ?

2) If i mention " X " address is there any problem ? , dont think wrongly as i really dont know

3) if i put " Y " address is my case ead and ap along with 485 will move to Texas centre ?
i really want to avoid it if chances are there in good way as my case before everything in Nebrasca centre compared to Texas centre procesing time is good

4) If i put " Y " address i will get any RFE ?
I really dont want that as my 485 was applied from " X " place.

Now working on H1b, 8th year
PD: Oct 2005
I 140: approved
I 485: pending
AP, EAD: approved

I want to change job to another employer.Can the new employer file an H1b for me based on my approved I 140. I prefer to be on H1b as traveling is easier and don't have to wait for the EAD, AP each year and the uncertainities invloved.

I would appreciate replies.

Yes, new employer can file H1B transfer, but I donno the rule for 8th year ext.
For AC21 you can always use H1B transfer or EAD.

When E-Filed my EAD Reniewal , I didn't filled these fields (14. Manner of Last Entry & 15.Current Immigration Status) as they are not mandatory fields.Will there be any problem with my application?Anybody on the same boat?If so can you share your experiances?

F1 is strictly non-immigrant VISA. So having family members in USA has a bearing on F1. On the other hand, bunch of H-1B applicants have relatives in USA. Also H-1B is dual intent VISA. So you should be OK with H-1B.

Never lie or give any false information on the application.
